Terms of Service

Welcome to Cubby. These Terms of Service ("Terms") are an agreement between you and [Legal entity — to be confirmed] ("Cubby", "we", "us") and govern your use of the Cubby app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Cubby.

Cubby is not medical advice. Cubby is an informational tool to help you record and organise your family's information. It does not provide medical, health, or professional advice, diagnosis, or treatment, and is not a substitute for your doctor, midwife, health visitor, or other qualified professional. Vaccine schedules, due dates, growth charts, and any guidance shown are general information that you must verify with your own healthcare provider. Always seek professional advice for medical questions, never disregard or delay it because of something in Cubby, and in an emergency call your local emergency number. You are solely responsible for decisions about your and your child's care.

1. Who can use Cubby

You must be at least 18 years old and able to form a binding contract. Cubby is for use by parents and caregivers to manage their own family's information. You are responsible for everyone you invite into your care circle and for what they do with the access you give them.

2. Your account

You sign in via Google, Apple, or an email link. You're responsible for keeping access to your account secure and for the accuracy of the information you provide. Tell us promptly if you believe your account has been compromised.

3. Your content and data

The information you enter (your "Content") remains yours. You grant us only the limited permission needed to host, process, and display it to you and the care-circle members you choose — for example to sync the log live across your family's devices. We do not sell your Content and we do not use it for advertising (see the Privacy Policy). You are responsible for the Content you enter and for ensuring you have the right to share information about others (including your child and care-circle members).

4. Acceptable use

Don't use Cubby to break the law, infringe others' rights, upload harmful or unlawful material, attempt to access other families' data, disrupt or reverse-engineer the Service, or resell it. We may suspend or end access that violates these Terms or risks other users.

5. Cubby Pro (subscriptions & billing)

Free tier: the core of Cubby — logging, sharing with your care circle, vaccine schedules, growth charts, and basic keepsakes — is free.
Cubby Pro: an optional paid subscription (currently $9/month or $90/year, with localised pricing) that unlocks premium features. It includes a 7-day free trial; if you don't cancel before the trial ends, the subscription begins and renews automatically each period until you cancel.
Payments & Merchant of Record: payments and subscription management are handled by our payment provider, Lemon Squeezy, acting as Merchant of Record and reseller. Your purchase is also subject to their terms, and they handle applicable taxes.
Cancellation & refunds: you can cancel anytime; see our Refund & Cancellation Policy.
Price changes: we may change prices or features; we'll give reasonable notice, and changes won't affect the period you've already paid for.

6. Our intellectual property

The Cubby app, website, name, logo, and content we create are owned by us and protected by law. These Terms don't give you any right to use our brand or copy the Service beyond normal use of the app.

7. Third-party services

Cubby relies on third parties (e.g. Google and Apple for sign-in, Lemon Squeezy for payments, Cloudflare and Google Firebase for infrastructure). Your use of those may also be subject to their terms, and we aren't responsible for their services.

8. Disclaimer of warranties

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any information in it (including schedules, charts, or guidance) is accurate, complete, or suitable for your situation. Use of the service is at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, Cubby and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profit, or goodwill, arising from or related to your use of (or inability to use) the service — including any reliance on information in it or any health, medical, or care decision. To the fullest extent permitted by law, our total liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

Some jurisdictions don't allow certain exclusions or limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence, or fraud).

10. Indemnification

You agree to indemnify and hold Cubby harmless from claims, damages, and reasonable costs arising from your misuse of the Service, your Content, or your breach of these Terms or of someone else's rights.

11. Termination

You can stop using Cubby and delete your account at any time. We may suspend or end access if you breach these Terms or to protect the Service or other users. You can export your data before leaving.

12. Changes

We may update these Terms; we'll post the new version here with an updated date and, for material changes, notify you in the app or by email. Continuing to use Cubby after changes means you accept them.

13. Governing law & disputes

These Terms are governed by [governing law — to be set on license issuance, e.g. the laws of the United Arab Emirates], and disputes will be handled by the courts of [jurisdiction — to be confirmed], except where mandatory consumer-protection law in your country of residence gives you other rights.
